(a) In addition to any other court costs and fees currently assessed in Morgan County, the following court costs shall be assessed:

Terms Used In Alabama Code 45-52-82.06

  • Arrest: Taking physical custody of a person by lawful authority.

(1) In all civil cases filed in the district court, including child support, a docket fee of fifteen dollars ($15) in each case.
(2) In all juvenile and quasi-criminal cases in the juvenile court, a docket fee of twenty dollars ($20) in each case. The fee shall be collected in all cases in which the defendant is found delinquent, a bond forfeited, a penalty imposed, or where there is issued any alias warrant of arrest.
(3) In all criminal cases, including traffic cases, in the circuit and district courts, a fee of thirty dollars ($30) in each case. The fee shall be collected in all cases in which the defendant is adjudged guilty, a bond forfeited, a penalty imposed, a dismissal with conditions, including a dismissal for successful completion of driving school or a dismissal of other court costs assessed, or where there is issued any alias warrant of arrest.
(4) In all civil cases filed in the circuit court, including domestic relations cases, a docket fee of thirty dollars ($30) in each case.
(b) The court costs collected pursuant to subsection (a) shall be disbursed monthly as follows:

(1) Fifteen percent to the office of the District Attorney of Morgan County payable to the Solicitor’s Fund to be used for the operation of the office or for any other purpose for which this fund was created.
(2) Sixty percent to the office of the Circuit Clerk of Morgan County payable to the Circuit Clerk’s Judicial Administration Fund to be used for the operation of the office or for any other purpose for which this fund was created.
(3) Twenty-five percent to the presiding Circuit Court Judge’s Judicial Administration Fund to be used for any purpose for which this fund may be used.
(c) An additional fee of seventy-five dollars ($75) shall be collected and paid to the Solicitor’s Fund in all cases involving issuance of a worthless check.
(d) The court costs authorized herein shall be in addition to and not in lieu of any other fees and costs and shall not be waived unless all fees and costs are waived.
