Terms Used In Alabama Code 5-19-30
- Conviction: A judgement of guilt against a criminal defendant.
- Finance charge: The total cost of credit a customer must pay on a consumer loan, including interest. The Truth in Lending Act requires disclosure of the finance charge. Source: OCC
- month: means a calendar month. See Alabama Code 1-1-1
- year: means a calendar year; but, whenever the word "year" is used in reference to any appropriations for the payment of money out of the treasury, it shall mean fiscal year. See Alabama Code 1-1-1
A creditor who willfully makes charges in excess of those permitted by Section finance charge; alternate per month computed finance charge” class=”unlinked-ref” datatype=”S” sessionyear=”2020″ statecd=”AL” title=”5″>5-19-3 or a creditor who willfully engages in the business of making loans in violation of subsection (a) of Section 5-19-22, or both, is guilty of a misdemeanor and, upon conviction, shall be sentenced to pay a fine not exceeding five hundred dollars ($500) or to imprisonment not exceeding one year, or both.
