Terms Used In Alabama Code 6-6-167
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Plaintiff: The person who files the complaint in a civil lawsuit.
- property: includes both real and personal property. See Alabama Code 1-1-1
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
The interposition of a claim for the trial of the right of property shall not prevent the plaintiff from levying on other property of the defendant in the process.
