(a) A person who is restricted from purchasing alcohol under Alaska Stat. § 04.16.160 may not knowingly enter or remain in premises licensed under this title to obtain or consume alcohol.

Terms Used In Alaska Statutes 04.16.047

  • action: includes any matter or proceeding in a court, civil or criminal. See Alaska Statutes 01.10.060
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
(b) A licensee may bring a civil action against a person who violates this section if the violation occurs on the premises of that licensee. If judgment is entered in favor of the licensee, the court shall award civil damages in the amount of $1,000 and award reasonable costs and reasonable attorney fees allowed under the Alaska Rules of Civil Procedure.
(c) Nothing in this section or Alaska Stat. § 04.16.160 creates a duty or imposes an obligation on a licensee to physically check the identification of any person entering licensed premises.
