(a) A pharmacist or person acting at the direction of a pharmacist shall disclose the price of filling any prescription when requested by the consumer.

Terms Used In Alaska Statutes 08.80.297

  • Contract: A legal written agreement that becomes binding when signed.
  • device: means an instrument, apparatus, implement, machine, contrivance, implant, or other similar or related article, including a component part or accessory, that is required under federal law to bear the label "Caution: Federal or state law requires dispensing by or on the order of a physician". See Alaska Statutes 08.80.480
  • drug: means an article recognized as a drug in an official compendium, or supplement to an official compendium. See Alaska Statutes 08.80.480
  • person: has the meaning given in Alaska Stat. See Alaska Statutes 08.80.480
  • pharmacist: means an individual currently licensed by this state to engage in the practice of pharmacy. See Alaska Statutes 08.80.480
  • pharmacy: means a place in this state where drugs are dispensed and pharmaceutical care is provided and a place outside of this state that is subject to licensure or registration under Alaska Stat. See Alaska Statutes 08.80.480
  • prescription drug: means a drug that, under federal law, before being dispensed or delivered, is required to be labeled with either of the following statements:
    (A) "Caution: Federal law prohibits dispensing without prescription". See Alaska Statutes 08.80.480
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
(b) No contract or agreement may prohibit a pharmacy, pharmacist, or pharmacy benefits manager from informing a patient of a less costly alternative for a prescription drug or medical device or supply, which may include the amount the patient would pay without the use of a health care plan.
(c) A pharmacist or person acting at the direction of a pharmacist shall notify the patient if a known less costly alternative for a prescription drug or medical device or supply is available, which may include the amount the patient would pay without the use of a health care plan.
(d) In this section,

(1) “health care plan” means a policy, contract, benefit, or agreement that provides, delivers, arranges for, pays for, or reimburses any of the costs of health care services under

(A) a health care insurance plan as defined under Alaska Stat. § 21.54.500;
(B) a governmental or employee welfare benefit plan under 29 U.S.C. § 1001State flexibility; construction” class=”unlinked-ref” datatype=”S” statecd=”US” title=”29″>1191 (Employee Retirement Income Security Act of 1974);
(C) a plan offered under Alaska Stat. § 39.30.090 or 39.30.091;
(D) a federal governmental plan as defined under Alaska Stat. § 21.54.500;
(E) the Medicaid or Medicare program; or
(F) a self-insured employer benefit plan;
(2) “pharmacy benefits manager” has the meaning given in Alaska Stat. § 21.27.955.
