Terms Used In Alaska Statutes 26.05.450

  • accuser: means a person who signs and swears to charges, a person who directs that charges nominally be signed and sworn to by another, and any other person who has an interest other than an official interest in the prosecution of the accused. See Alaska Statutes 26.05.990
  • militia of the state: means the Alaska National Guard, the Alaska Naval Militia, and the Alaska State Defense Force. See Alaska Statutes 26.05.990
  • officer: means a commissioned or warrant officer. See Alaska Statutes 26.05.990
(1) the governor;
(2) the adjutant general;
(3) the commanding officer of a force of the militia of the state;
(4) the commanding officer of a division or a separate brigade;
(5) the commanding officer of a separate wing.
(b) If a commanding officer who is authorized to convene a general court-martial is the accuser in a matter, the court hearing the matter shall be convened by superior competent authority.
(c) A superior authority may convene a case if the superior authority considers it desirable.
