(a) A fine imposed by a military court or through the imposition of nonjudicial punishment may be paid to the state and delivered to the court or imposing officer, or to a person executing process.

Terms Used In Alaska Statutes 26.05.670

  • department: means the Department of Military and Veterans' Affairs. See Alaska Statutes 26.05.990
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • military court: means a court-martial. See Alaska Statutes 26.05.990
  • militia of the state: means the Alaska National Guard, the Alaska Naval Militia, and the Alaska State Defense Force. See Alaska Statutes 26.05.990
  • officer: means a commissioned or warrant officer. See Alaska Statutes 26.05.990
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
  • property: includes real and personal property. See Alaska Statutes 01.10.060
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
(b) If the person on whom the fine was imposed fails to pay, the department may collect the fine by

(1) retaining pay or allowances due or to become due to the person fined from the militia of the state or the United States;
(2) garnishment or levy, together with costs, on the wages, goods, and property of a person delinquent in paying a fine in accordance with Alaska Stat. Chapter 09.38.
(c) A fine or penalty required to be paid under this section shall be deposited into the general fund and accounted for under Alaska Stat. § 37.05.142.
