Terms Used In Alaska Statutes 28.15.161

  • cancel: means to annul or terminate, by formal action of the department, a certification, registration, license, permit or privilege issued or allowed under this title or regulations adopted under this title, because of an error or defect in the document issued or the application for issuance or because the person holding the document is no longer entitled to it. See Alaska Statutes 28.90.990
  • department: means the Department of Administration. See Alaska Statutes 28.90.990
  • driver: means a person who drives or is in actual physical control of a vehicle. See Alaska Statutes 28.90.990
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • license: when used in relation to driver licensing, means a license, provisional license, or permit to drive a motor vehicle, or the privilege to drive or to obtain a license to drive a motor vehicle, under the laws of this state whether or not a person holds a valid license issued in this or another jurisdiction. See Alaska Statutes 28.90.990
  • motor vehicle: means a vehicle which is self-propelled except a vehicle moved by human or animal power. See Alaska Statutes 28.90.990
  • vehicle: means a device in, upon, or by which a person or property may be transported or drawn upon or immediately over a highway or vehicular way or area. See Alaska Statutes 28.90.990
(1) the licensee is not medically or otherwise entitled to the issuance or retention of the license, or has been adjudged incompetent to drive a motor vehicle;
(2) there is an error or defect in the license;
(3) the licensee failed to give the required or correct information in the licensee’s application;
(4) the license was obtained fraudulently;
(5) the licensee is restricted from purchasing alcoholic beverages under Alaska Stat. § 04.16.160; if a license is cancelled under this paragraph, when a new license is issued, it must reflect that restriction and the requirements of gift and living will document” class=”unlinked-ref” datatype=”S” sessionyear=”2023″ statecd=”AK”>Alaska Stat. § 28.15.111 if the period of restriction under Alaska Stat. § 04.16.160 is still in effect;
(6) the licensee has a license issued under Alaska Stat. § 28.15.046 and has been convicted of an offense described in Alaska Stat. § 28.15.046 (c) or (d) that would disqualify the licensee from obtaining a license under that section; or
(7) the licensee owes $1,000 or more in unpaid fines for offenses involving a moving motor vehicle and failed to

(A) pay the fines in full as required by the court; or
(B) make payments in good faith on the unpaid balance of the fines under a payment plan established by the department.
(b) The licensee may apply for a new license at any time after cancellation upon removal of the cause for the cancellation.
