(a) In a determination made by a state official under Alaska Stat. § 36.30.30036.30.310, the state official making the determination shall independently examine the material facts of the procurement and independently determine whether the procurement is eligible for the procurement method requested.

  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
(b) If a state official knowingly makes a false statement in a determination made under Alaska Stat. § 36.30.30036.30.310, the state official is guilty of a class A misdemeanor.
