(a) Except as provided in (b) of this section, a lessee may sublease or assign the leased land or a portion of it if, after application to the director, the director issues a permit. The director may issue a permit upon a finding that it is in the best interests of the state to do so.

Terms Used In Alaska Statutes 38.05.095

  • director: means the director of the division of lands of the Department of Natural Resources. See Alaska Statutes 38.05.965
  • land: means all land, including shoreland, tideland , and submerged land, or resources belonging to or acquired by the state. See Alaska Statutes 38.05.965

(b) A nonprofit organization that is exempted from paying rent on state land under Alaska Stat. § 38.05.810 may not sublease or assign the land or a portion of it on which it has a lease.
