(a) The Department of Natural Resources shall manage the land which is the subject of Alaska Stat. § 38.05.50038.05.505. The department will use the provisions of this chapter for the management of the land except to the extent that the provisions of Alaska Stat. § 38.05.50038.05.505 provide to the contrary.

Terms Used In Alaska Statutes 38.05.501

  • department: means the Department of Natural Resources. See Alaska Statutes 38.05.965
  • land: means all land, including shoreland, tideland , and submerged land, or resources belonging to or acquired by the state. See Alaska Statutes 38.05.965
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
(b) The department shall manage the land in an orderly and beneficial manner.
(c) The department may adopt regulations for the management of the land. No regulation which imposes a limitation upon the people of the state is effective until approved by the legislature.
(d) The department may sell, lease, exchange, or encumber the land when specifically authorized to do so by law and under the terms and conditions established by the law.
