(a) Except as provided in (b) of this section, the names, addresses, or other personal identifying information of people who have used materials made available to the public by a library shall be kept confidential, except upon court order, and are not subject to inspection under Alaska Stat. § 40.25.110 or 40.25.120. This section applies to a library operated by the state, a municipality, or a public school, including the University of Alaska.

Terms Used In Alaska Statutes 40.25.140

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • municipality: means a political subdivision incorporated under the laws of the state that is a home rule or general law city, a home rule or general law borough, or a unified municipality. See Alaska Statutes 01.10.060
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
(b) Records of a public elementary or secondary school library identifying a minor child shall be made available on request to a parent or guardian of that child.
