A. The governing board is liable as such, in the name of the school district, for a judgment against the district for salary due a teacher on contract and for all debts contracted under this title. It shall pay judgments or liabilities from the school monies to the credit of the district.

Terms Used In Arizona Laws 15-381

  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Contract: A legal written agreement that becomes binding when signed.
  • Governing board: means a body organized for the government and management of the schools within a school district or a county school superintendent in the conduct of an accommodation school. See Arizona Laws 15-101
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • School district: means a political subdivision of this state with geographic boundaries organized for the purpose of the administration, support and maintenance of the public schools or an accommodation school. See Arizona Laws 15-101

B. The governing board members shall have no personal liability for acts done in reliance upon written opinions of the attorney general or upon written opinions of the county attorney:

1. Which are deemed to be affirmed by the attorney general pursuant to section 15-253.

2. With which the attorney general concurs.

3. Which the attorney general declines to review.

4. As revised by a written opinion of the attorney general.

C. Members of a governing board are immune from personal liability with respect to all acts done and actions taken in good faith within the scope of their authority during duly constituted regular and special meetings.
