A. After an impartial investigation, the director may notify a transporter who is allegedly violating this article of a hearing to be held before the director after ten days. On hearing the evidence and on finding and determining that fraud has been committed in the application for a certificate or a transporter license plate or tab or in the use of a plate or tab or that there is no satisfactory proof of the status of the transporter, the director may withhold, suspend or revoke a certificate or a transporter license plate or tab.

Terms Used In Arizona Laws 28-4627

  • Director: means the director of the department of transportation. See Arizona Laws 28-101
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fraud: Intentional deception resulting in injury to another.
  • Transporter: means a person who is lawfully engaged in the business of transporting or delivering vehicles that are not the person's own and vehicles of a type otherwise required to be registered, by the driveaway or towaway methods, from a point of manufacture, assembly or distribution or from the owner of the vehicles to a dealer or sales agent of a manufacturer or to any consignee designated by the shipper or consignor. B. On good cause shown, the director may reissue a certificate or a transporter license plate or tab after it has been withheld, suspended or revoked.
