A. The director may:

Terms Used In Arizona Laws 28-953

  • All-terrain vehicle: means either of the following:

    (a) A motor vehicle that satisfies all of the following:

    (i) Is designed primarily for recreational nonhighway all-terrain travel. See Arizona Laws 28-101

  • Director: means the director of the department of transportation. See Arizona Laws 28-101
  • highway: means the entire width between the boundary lines of every way if a part of the way is open to the use of the public for purposes of vehicular travel. See Arizona Laws 28-101
  • Motor driven cycle: means a motorcycle, including every motor scooter, with a motor that produces not more than five horsepower but does not include an electric bicycle, an electric miniature scooter or an electric standup scooter. See Arizona Laws 28-101
  • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215

1. Require an inspection of the brake on an all-terrain vehicle or a motor driven cycle.

2. Disapprove a brake that does not comply with the performance ability standard provided in section 28-952 or that is not so designed or constructed to ensure reasonable and reliable performance in actual use.

B. The director may refuse to register or may suspend or revoke the registration of a vehicle referred to in this section if the director determines that the brake on the vehicle does not comply with this section.

C. A person shall not operate on a highway a vehicle referred to in this section if the director has disapproved the brake equipment on the vehicle or type of vehicle.
