A. The department shall establish procedures to monitor the performance of department employees that include, if applicable, using evaluations obtained from taxpayers.

Terms Used In Arizona Laws 42-2058

  • Department: means the department of revenue. See Arizona Laws 42-1001
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. B. Fair and equitable treatment of taxpayers is a criterion for evaluating employee performance, including being free of favoritism or bias, reasonable and consistent with the laws of this state and the rules, procedures and rulings of the department.

C. The department shall not evaluate an employee on the basis of taxes assessed or collected by that employee.
