Arizona Laws 48-4971. Undertaking of replenishment obligation
A. At any time after the adoption of a plan of permanent operation and administration under section 48-4806, subsection B, the board may elect to adopt an ordinance or resolution to undertake the water district groundwater replenishment obligation of any and all real property and municipal providers that thereafter qualify as, respectively, water district member lands and water district member service areas under this article.
Terms Used In Arizona Laws 48-4971
- Board: means either the initial board of directors or the permanent board of directors of a district. See Arizona Laws 48-4801
- District: means an active management area water district established under this chapter. See Arizona Laws 48-4801
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- Resolution: means a resolution, adopted by the governing body of a city or town, by the board of directors of a private water company that is a corporation, by the general partners of a private water company that is a partnership or by the individual owners of a private water company that is individually owned. B. Following the adoption of such ordinance or resolution the district shall perform the duties and obligations set forth in this article.
C. The district shall promptly notify the director of water resources and any replenishment authority established under chapter 22 of this title of the adoption of such ordinance or resolution.
