A. The board may contract and enter into stipulations of any nature and do all acts necessary and convenient for the full exercise of the powers granted in this chapter, except that the board shall not exercise the power of eminent domain.

Terms Used In Arizona Laws 48-5123

  • Authority: means a regional public transportation authority organized under this chapter. See Arizona Laws 48-5101
  • Board: means the board of directors of a regional public transportation authority. See Arizona Laws 48-5101
  • Contract: A legal written agreement that becomes binding when signed.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Property: includes both real and personal property. See Arizona Laws 1-215

B. The cities and towns or county may exercise the right of eminent domain pursuant to Title 12, Chapter 8, Article 2 for the purposes prescribed in this chapter, in behalf of the authority, and sell or lease to the authority any property acquired through eminent domain proceedings.
