The owner or operator of all solid waste facilities that are not listed in either section 49-762 or 49-762.02 or are not regulated under Title 40 of the Code of Federal Regulations, Part 257, subpart D or under article 11 of this chapter in a program approved by the United States environmental protection agency shall comply with self-certification procedures prescribed by Section 49-762.05. A waste tire facility that is not required to obtain solid waste facility plan approval pursuant to section 49-762, paragraph 7 must comply with self-certification procedures as prescribed in Section 49-762.05.
Terms Used In Arizona Laws 49-762.01
- Facility plan: means any design or operating plan for a solid waste facility or group of solid waste facilities other than a permit issued under article 11 of this chapter. See Arizona Laws 49-701
- United States: includes the District of Columbia and the territories. See Arizona Laws 1-215
- Waste tire facility: means a solid waste facility at which five thousand or more waste tires are stored outdoors on any day. See Arizona Laws 49-701
