A. No person other than a natural person shall dispose of solid waste at a solid waste landfill within the boundaries of this state unless the facility meets the applicable requirements of titles III and IV of the federal water pollution control act amendments of 1972, as amended (P.L. 92-500; 86 Stat. 816; 33 United States Code § 1151), and one of the following:

Terms Used In Arizona Laws 49-773

  • Facility plan: means any design or operating plan for a solid waste facility or group of solid waste facilities other than a permit issued under article 11 of this chapter. See Arizona Laws 49-701
  • Person: means any public or private corporation, company, partnership, firm, association or society of persons, the federal government and any of its departments or agencies, this state or any of its agencies, departments, political subdivisions, counties, towns or municipal corporations, as well as a natural person. See Arizona Laws 49-701
  • United States: includes the District of Columbia and the territories. See Arizona Laws 1-215

1. Title 40 of the Code of Federal Regulations, Part 257 as amended on October 9, 1991 and October 1, 1993 and, if applicable, beginning October 9, 1993, Title 40 of the Code of Federal Regulations, Part 258, as promulgated on October 9, 1991 and amended on October 1, 1993.

2. A solid waste facility plan approval pursuant to section 49-762 that was issued after October 1, 1993.

B. For the purposes of this section, unless the context otherwise requires, "solid waste" has the same meaning as provided in section 49-701.
