A. A hazardous waste fuel penalty of forty cents per gallon is established for hazardous waste fuel and hazardous waste that are burned for energy recovery and that are not generated by the operation of the business of the burner.
Terms Used In Arizona Laws 49-932
- Director: means the director of environmental quality who is also the director of the department. See Arizona Laws 49-101
- Hazardous waste: means garbage, refuse, sludge from a waste treatment plant, water supply treatment plant or air pollution control facility, or other discarded materials, including solid, liquid, semisolid or contained gaseous material, resulting from industrial, commercial, mining and agricultural operations or from community activities which because of its quantity, concentration or physical, chemical or infectious characteristics may cause or significantly contribute to an increase in mortality or an increase in serious irreversible or incapacitating reversible illness or pose a substantial present or potential hazard to human health or the environment if improperly treated, stored, transported, disposed of or otherwise managed or any waste identified as hazardous pursuant to section 49-922. B. The director shall collect the penalty established by subsection A of this section from the burner of the hazardous waste fuel or hazardous waste.
C. Monies collected pursuant to subsection B of this section shall be deposited, pursuant to sections 35-146 and 35-147, in the state general fund.
