- Administration: means the Arizona health care cost containment system administration. See Arizona Laws 36-2901

- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- Agreement: means any agreement or contract. See Arizona Laws 9-1401
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- boundaries: means all of the area within the corporate limits of the city or town. See Arizona Laws 9-1401
- Capitation rate: means a mode of payment which the program contractor receives for the delivery of services to members pursuant to this article and which is based on a fixed rate per person notwithstanding the amount of services provided to a member. See Arizona Laws 36-2931
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- contiguous: means land that adjoins or touches the other property held by the same or a related organization and land divided by a public road. See Arizona Laws 36-2999.51
- Contract: A legal written agreement that becomes binding when signed.
- Contractor: means a person or entity that has a prepaid capitated contract with the administration pursuant to section 36-2904 or chapter 34 of this title to provide health care to members under this article or persons under chapter 34 of this title either directly or through subcontracts with providers. See Arizona Laws 36-2901
- Contractor: means a person or entity that has a prepaid capitated contract with the administration pursuant to section 36-2904 to provide health care to members under this article either directly or through subcontracts with providers. See Arizona Laws 36-2971
- Contractor: means a health plan that contracts with the administration to provide hospitalization and medical care to members according to this article or a qualifying plan. See Arizona Laws 36-2981
- Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Day: means a calendar day, except a Saturday or Sunday or a holiday prescribed in section 1-301. See Arizona Laws 9-1401
- Department: means the department of economic security. See Arizona Laws 36-2901

- Dependent: A person dependent for support upon another.
- Director: means the director of the Arizona health care cost containment system administration. See Arizona Laws 36-2901

- Director: means the director of the administration. See Arizona Laws 36-2981
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Eligible person: means any person who is:
(a) Any of the following:
(i) Defined as mandatorily or optionally eligible pursuant to title XIX of the social security act as authorized by the state plan. See Arizona Laws 36-2901
- Eligible person: means a person who:
(a) Is a resident of this state and a United States citizen or a person who meets the requirements for qualified alien status as determined pursuant to Section 36-2903. See Arizona Laws 36-2931
- Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Escrow: Money given to a third party to be held for payment until certain conditions are met.
- Ex officio: Literally, by virtue of one's office.
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- Federal poverty guidelines: means the poverty guidelines as updated annually in the federal register by the United States department of health and human services. See Arizona Laws 1-215
- Federal poverty level: means the federal poverty level guidelines published annually by the United States department of health and human services. See Arizona Laws 36-2981
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Fiscal year: means the period beginning on October 1 and ending on September 30. See Arizona Laws 36-2999.51
- Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
- You are late making a payment or commit some other default, triggering an increase to a penalty rate
- The bank changes the terms of your account and you do not reject the change.
- The rate expires (if the rate was fixed for only a certain period of time).
- Fraud: Intentional deception resulting in injury to another.
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Graduate medical education: means a program, including an approved fellowship, that prepares a physician for the independent practice of medicine by providing didactic and clinical education in a medical discipline to a medical student who has completed a recognized undergraduate medical education program. See Arizona Laws 36-2901
- Grantee: includes every person to whom an estate or interest in real property passes, in or by a deed. See Arizona Laws 1-215
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Health plan: means an entity that contracts with the administration for services provided pursuant to article 1 of this chapter. See Arizona Laws 36-2981
- Highway: means all roads, streets and alleys and other dedicated public rights-of-way that are operated and maintained by a local government. See Arizona Laws 9-1401
- Holder: means a video service provider that has been issued a uniform video service license pursuant to this chapter. See Arizona Laws 9-1401
- Home and community based services: means services described in section 36-2939, subsection B, paragraph 2 and subsection C. See Arizona Laws 36-2931
- Incumbent cable operator: means a cable operator or other video service provider that on December 31, 2019 is providing video service in this state pursuant to a local license. See Arizona Laws 9-1401
- Institutional services: means services described in section 36-2939, subsection A, paragraph 1 and subsection B, paragraph 1. See Arizona Laws 36-2931
- Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- License: means a franchise as defined in 47 United States Code § 522. See Arizona Laws 9-1401
- License fee: means a license fee imposed by a local government on a video service provider for using the highways to provide and for the privilege of providing video service. See Arizona Laws 9-1401
- Lien: A claim against real or personal property in satisfaction of a debt.
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Local government: means any city, including a charter city, or town. See Arizona Laws 9-1401
- Local law: means any charter, code, ordinance, resolution, regulation or other law of a local government. See Arizona Laws 9-1401
- Local license: means any license, agreement, permit or similar authorization that meets all of the following:
(a) Allows a person to construct or operate a video service network within the boundaries of a local government. See Arizona Laws 9-1401
- Malice: means evil intent and outrageous, oppressive or intolerable conduct that creates a substantial risk of tremendous harm to others. See Arizona Laws 36-2901
- Medicare resident days: means resident days that are funded by the medicare program, a medicare advantage or special needs plan or the medicare hospice program. See Arizona Laws 36-2999.51
- Member: means an eligible person who enrolls in the system. See Arizona Laws 36-2901
- Member: means an eligible person who is enrolled in the system. See Arizona Laws 36-2931
- Member: means an eligible person who enrolls in the system and who is defined as a qualified medicare beneficiary pursuant to section 1905(p) of title XIX of the social security act and whose income does not exceed one hundred per cent of the federal poverty guidelines. See Arizona Laws 36-2971
- Member: means a person who is eligible for and enrolled in the program, who is under nineteen years of age and whose gross household income meets the following requirements:
(a) Beginning on October 1, 1999 through September 30, 2023, has income at or below two hundred percent of the federal poverty level. See Arizona Laws 36-2981
- Minor: means a person under eighteen years of age. See Arizona Laws 1-215
- Minority leader: See Floor Leaders
- Month: means a calendar month unless otherwise expressed. See Arizona Laws 1-215
- Net patient service revenue: means gross inpatient revenues from services that are provided to nursing facility patients minus reductions from gross inpatient revenue. See Arizona Laws 36-2999.51
- Noncontracting provider: means a person who provides health care to members pursuant to this article but not pursuant to a subcontract with a contractor. See Arizona Laws 36-2901
- Noncontracting provider: means a person who provides services as prescribed by section 36-2939 and who does not have a subcontract with a program contractor. See Arizona Laws 36-2931
- Noncontracting provider: means an entity that provides hospital or medical care but does not have a contract or subcontract with the administration. See Arizona Laws 36-2981
- Nursing facility: means a health care institution that provides inpatient beds or resident beds and nursing services to persons who need nursing services on a continuing basis but who do not require hospital care or direct daily care from a physician. See Arizona Laws 36-2999.51
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Oversight: Committee review of the activities of a Federal agency or program.
- Physician: means a person who is licensed pursuant to Title 32, Chapter 13 or 17. See Arizona Laws 36-2901
- Physician: means a person who is licensed pursuant to Title 32, Chapter 13 or 17. See Arizona Laws 36-2981
- Population: means the population according to the most recent United States decennial census. See Arizona Laws 1-215
- Prepaid capitated: means a mode of payment by which a health care contractor directly delivers health care services for the duration of a contract to a maximum specified number of members based on a fixed rate per member notwithstanding:
(a) The actual number of members who receive care from the contractor. See Arizona Laws 36-2901
- Primary care physician: means a physician who is a family practitioner, general practitioner, pediatrician, general internist, or obstetrician or gynecologist. See Arizona Laws 36-2901
- Primary care physician: means a physician who is a family practitioner, general practitioner, pediatrician, general internist, or obstetrician or gynecologist. See Arizona Laws 36-2971
- Primary care physician: means a physician who is a family practitioner, general practitioner, pediatrician, general internist, obstetrician or gynecologist. See Arizona Laws 36-2981
- Primary care practitioner: means a nurse practitioner or certified nurse midwife who is certified pursuant to Title 32, Chapter 15 or a physician assistant who is licensed pursuant to Title 32, Chapter 25. See Arizona Laws 36-2901
- Primary care practitioner: means a nurse practitioner certified pursuant to Title 32, Chapter 15 or a physician assistant certified pursuant to Title 32, Chapter 25. See Arizona Laws 36-2971
- Primary care practitioner: means a nurse practitioner who is certified pursuant to Title 32, Chapter 15 or a physician assistant who is licensed pursuant to Title 32, Chapter 25 and who is acting within the respective scope of practice of those chapters. See Arizona Laws 36-2981
- Probate: Proving a will
- Process: means a citation, writ or summons issued in the course of judicial proceedings. See Arizona Laws 1-215
- Program: means the children's health insurance program. See Arizona Laws 36-2981
- Program contractor: means the department or any other entity that contracts with the administration pursuant to section 36-2940 or 36-2944 to provide services to members pursuant to this article. See Arizona Laws 36-2931
- Program contractor: means the department or any other entity that contracts with the administration pursuant to section 36-2940 or 36-2944. See Arizona Laws 36-2971
- Property: includes both real and personal property. See Arizona Laws 1-215
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Provider: means a person who subcontracts with a program contractor for the delivery of services to members pursuant to this article. See Arizona Laws 36-2931
- Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
- Qualified medicare beneficiary only: means an eligible person who is determined eligible pursuant to this article and who is not enrolled as a member under either article 1 or 2 of this chapter. See Arizona Laws 36-2971
- Qualifying plan: means a contractor that contracts with the state pursuant to section 38-651 to provide health and accident insurance for state employees and that provides services to members pursuant to section 36-2989, subsection A. See Arizona Laws 36-2981
- Quorum: The number of legislators that must be present to do business.
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- Reductions from gross inpatient revenue: includes bad debts, contractual adjustments, uncompensated care, administrative, courtesy and policy discounts, adjustments and other similar revenue deductions. See Arizona Laws 36-2999.51
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Resident day: means a calendar day of care provided to a nursing facility resident, including the day of admission and excluding the day of discharge. See Arizona Laws 36-2999.51
- Service area: means that part of the boundaries of a local government within which a video service provider is authorized to provide video service pursuant to a uniform video service license or a local license. See Arizona Laws 9-1401
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- Special health care district: means a special health care district organized pursuant to Title 48, Chapter 31. See Arizona Laws 36-2901

- State plan: means a written agreement between the centers for medicare and medicaid services and the Arizona health care cost containment system administration that describes eligibility, covered services and the requirements for participation in the medicaid program except those requirements that are waived pursuant to the research and demonstration waiver pursuant to section 1115 of the social security act. See Arizona Laws 36-2931
- Subpoena: A command to a witness to appear and give testimony.
- System: means the Arizona health care cost containment system established by this article. See Arizona Laws 36-2901
- System: means the Arizona long-term care system. See Arizona Laws 36-2931
- System: means the Arizona health care cost containment system established by article 1 of this chapter and the Arizona long-term care system established by article 2 of this chapter. See Arizona Laws 36-2971
- Telecommunications service: means the offering of telecommunications for a fee directly to the public, or to such users as to be effectively available directly to the public, regardless of the equipment, facilities or technology used. See Arizona Laws 9-1401
- Tribal facility: means a facility that is operated by an Indian tribe and that is authorized to provide services pursuant to Public Law 93-638, as amended. See Arizona Laws 36-2981
- Trustee: A person or institution holding and administering property in trust.
- Uniform accounting system: means a standard method of collecting, recording and safeguarding Arizona long-term care system data. See Arizona Laws 36-2931
- Uniform video service license: means a license that is issued by a local government in the form of a uniform video service license agreement as adopted pursuant to section 9-1411. See Arizona Laws 9-1401
- United States: includes the District of Columbia and the territories. See Arizona Laws 1-215
- Upper payment limit: means the limitation established pursuant to 42 C. See Arizona Laws 36-2999.51
- Writing: includes printing. See Arizona Laws 1-215
