A trustee has the following powers without the need to obtain court authorization:
(a) The powers conferred by the trust instrument.
Terms Used In California Probate Code 16200
- Instrument: means a will, a document establishing or modifying a trust, a deed, or any other writing that designates a beneficiary or makes a donative transfer of property. See California Probate Code 45
- Statute: A law passed by a legislature.
- Trust: includes the following:

- Trustee: A person or institution holding and administering property in trust.
- Trustee: includes an original, additional, or successor trustee, whether or not appointed or confirmed by a court. See California Probate Code 84
(b) Except as limited in the trust instrument, the powers conferred by statute.
(c) Except as limited in the trust instrument, the power to perform any act that a trustee would perform for the purposes of the trust under the standard of care provided in Section 16040 or 16047.
