A consumer shall be referred to a provider of habilitation services under this chapter when all of the following apply:
(a) The individual is an adult who has been diagnosed as having a developmental disability.
Terms Used In California Welfare and Institutions Code 4852
- Consumer: means a person who has a disability that meets the definition of developmental disability set forth in subdivision (a). See California Welfare and Institutions Code 4512
- Developmental disability: means a disability that originates before an individual attains 18 years of age, continues, or can be expected to continue, indefinitely, and constitutes a substantial disability for that individual. See California Welfare and Institutions Code 4512
(b) The individual is determined to be in need of and has chosen habilitation services through the individual program planning process pursuant to Section 4646.
