(a) In a county or group of counties where services are available, as provided in Section 5348, and in accordance with the requirements of Section 5346, a court may order a person who is the subject of a petition filed pursuant to this section to obtain assisted outpatient treatment if the court finds, by clear and convincing evidence, both of the following:

(1) The facts stated in the verified petition filed in accordance with this section are true.

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.

(2) The person meets the definition of an eligible conservatee as set forth in this section.

(b) An “eligible conservatee” is a person who is a conservatee under this part who is the subject of a pending petition to terminate a conservatorship, who meets the criteria of Section 5346, and who, if the petition were granted, would benefit from assisted outpatient treatment to reduce the risk of deteriorating mental health while living independently.
