The commissioner may revoke, refuse or suspend the registration of any brand of fertilizer or refuse to register any brand of fertilizer as herein provided, upon satisfactory evidence that the registrant or applicant for registration has violated any provision of this chapter or has used fraudulent or deceptive practices in the evasion or attempted evasion of the provisions of this chapter or any regulations adopted thereunder; provided no registration shall be revoked, refused or suspended until the registrant has been given the opportunity to appear for a hearing by the commissioner or the commissioner’s designee.

Terms Used In Connecticut General Statutes 22-111l

  • Brand: means a term, design or trademark used in connection with one or more grades of fertilizer. See Connecticut General Statutes 22-111b
  • Commissioner: means the Commissioner of Agriculture. See Connecticut General Statutes 22-111b
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fertilizer: means any substance containing one or more recognized plant nutrients, which is used for its plant nutrient content and which is designed for use or claimed to have value in promoting plant growth. See Connecticut General Statutes 22-111b
  • Registrant: means a person who registers fertilizer pursuant to public act 09-229*. See Connecticut General Statutes 22-111b
