On and after January 1, 2023, no state department, board or agency may grant, deny or revoke the license or charter of any person on the basis of that person’s erased criminal history record information, except that the Department of Motor Vehicles may consider erased criminal history record information to the extent required by 49 C.F.R. § part 384, as amended from time to time.
