(a) Upon receipt of the application for a mail ballot from an elector under § 5604A of this title, the Department shall process the same and confirm that the elector qualifies to vote under this title.

Terms Used In Delaware Code Title 15 Sec. 5605A

  • Ballot: means those portions of cardboard, paper or other material to be placed within the ballot frames of a voting machine or to be used for absentee voting in order to list the names of the offices to be voted for, the name of each candidate and the designation of the party by which the candidate is nominated, a space for the voter to write in the name of any candidate of that voter's choice for any office, and the statement of any question submitted with provision for a "yes" or "no" vote. See Delaware Code Title 15 Sec. 101
  • Department: means the State Department of Elections, consisting of the State Board of Elections and such staff as the Board shall appoint under this title, but shall not include the State Election Commissioner. See Delaware Code Title 15 Sec. 101

(b) No more than 30 days but not less than 7 days before an election, and within 3 days after the ballots, ballot envelopes, and instructions become available, the Department shall mail all of the following to each elector who requested and qualified for a mail ballot:

(1) A mail ballot for the election district in which the elector resides.

(2) The instructions for completing and returning the mail ballot under § 5607A of this title.

(3) The ballot envelope required under § 5606A of this title.

(c) Postage for all mailings under subsection (b) of this section must be prepaid by the Department.

(d) This section does not prevent the issuance of a mail ballot to a qualified elector when the request is made less than 7 days before the election.
