- Abandoned: means left without provision for reasonable and necessary care or supervision. See Delaware Code Title 13 Sec. 1902
- Academic year: shall mean the 3 consecutive academic semesters beginning with the fall semester. See Delaware Code Title 14 Sec. 3402A
- Academic year: shall mean the 2 consecutive academic semesters beginning with the fall semester. See Delaware Code Title 14 Sec. 3410A

- Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
- adult person: means a person of the age of 18 years or older. See Delaware Code Title 1 Sec. 302
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Affiliate: means a person that directly, or indirectly through 1 or more intermediaries, controls, or is controlled by, or is under common control with, the person specified. See Delaware Code Title 5 Sec. 773
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- Applicant: means a school district, as defined in this title, acting independently, or as part of a consortia with other school districts, or an institution of higher education acting on behalf of school districts, or a charter school established under Chapter 5 of this title. See Delaware Code Title 14 Sec. 4503
- Appointed standby guardian: means a person appointed pursuant to this subchapter to assume the powers and duties of guardianship of a child upon the death or determination of incapacity or debilitation of the parent, custodian, or guardian. See Delaware Code Title 13 Sec. 2362
- Attending physician: means the physician who has primary responsibility for the treatment and care of the parent, custodian or guardian. See Delaware Code Title 13 Sec. 2362
- Ballot: means those portions of cardboard, paper or other material to be placed within the ballot frames of a voting machine or to be used for absentee voting in order to list the names of the offices to be voted for, the name of each candidate and the designation of the party by which the candidate is nominated, a space for the voter to write in the name of any candidate of that voter's choice for any office, and the statement of any question submitted with provision for a "yes" or "no" vote. See Delaware Code Title 15 Sec. 101
- Bank: means a state or a national bank. See Delaware Code Title 5 Sec. 781
- Bank: means a Delaware state bank, out-of-state state bank, Delaware national bank or out-of-state national bank. See Delaware Code Title 5 Sec. 795
- Bank holding company: has the meaning specified in the Bank Holding Company Act of 1956, as amended, 12 U. See Delaware Code Title 5 Sec. 795
- Board: means that body of individuals appointed by the Governor and confirmed by the Senate to serve or who otherwise serve as the State Board of Elections in accordance with Chapter 2 of this title, and are, as such, vested with the responsibility and power to see to the administration of the election laws of this State as more particularly defined in this title. See Delaware Code Title 15 Sec. 101
- Board: means a board of education of a reorganized school district. See Delaware Code Title 14 Sec. 1401
- Board: means the Board of Trustees of the Delaware Technical and Community College. See Delaware Code Title 14 Sec. 9101
- Board: means the Plans Management Board pursuant to § 2722 of Title 29. See Delaware Code Title 14 Sec. 3485
- Branch office: has the meaning specified in § 770 of this title. See Delaware Code Title 5 Sec. 795
- Branch office: has the meaning specified in § 770 of this chapter and also includes a foreign branch office as specified in § 771 of this chapter. See Delaware Code Title 5 Sec. 796
- Candidate: means a student enrolled in a public school or a post-secondary institution of higher learning in Delaware. See Delaware Code Title 14 Sec. 4503
- Case law: The law as laid down in cases that have been decided in the decisions of the courts.
- Child: means an individual who has not attained 18 years of age. See Delaware Code Title 13 Sec. 1902
- Child: means a person of 3 years of age, or an earlier age if otherwise provided in this title, until the receipt of a regular high school diploma or the end of the school year in which the person attains the age of 22, whichever occurs first. See Delaware Code Title 14 Sec. 3101
- Child custody determination: means a judgment, decree or other order of a court providing for the legal custody, physical custody or visitation with respect to a child. See Delaware Code Title 13 Sec. 1902
- Child custody proceeding: means a proceeding in which legal custody, physical custody or visitation with respect to a child is an issue. See Delaware Code Title 13 Sec. 1902
- Child with a disability: means a child who because of mental, physical, emotional, developmental, speech or learning disability problems, as defined by the Department of Education rules and regulations approved by the State Board of Education, requires special education and related services in order to develop that person's own capabilities. See Delaware Code Title 14 Sec. 3101
- Clerk: means clerk of election. See Delaware Code Title 15 Sec. 101
- Codicil: An addition, change, or supplement to a will executed with the same formalities required for the will itself.
- College: means the Delaware Technical and Community College. See Delaware Code Title 14 Sec. 9101
- Commencement: means the filing of the first pleading in a proceeding. See Delaware Code Title 13 Sec. 1902
- Continuance: Putting off of a hearing ot trial until a later time.
- Continuing bank: means a merging bank, the charter of which becomes the charter of the resulting bank. See Delaware Code Title 5 Sec. 781
- Control: means beneficial ownership directly, or indirectly through 1 or more intermediaries, of more than 50 per centum of the voting securities or partnership interests in any person other than an individual. See Delaware Code Title 5 Sec. 773
- Converting bank: means a bank converted from a state to a national bank, or the reverse. See Delaware Code Title 5 Sec. 781
- County committee: means the regularly organized and constituted county committee or governing authority of a political party. See Delaware Code Title 15 Sec. 101
- court: as used in this chapter shall mean either the Resident Judge of the county in which the person appealing the decision resides, or, in case of such judge's disability or absence from the county, any judge entitled to sit in the Supreme Court. See Delaware Code Title 15 Sec. 2101
- Court: means the Family Court of the State. See Delaware Code Title 13 Sec. 1902
- Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
- CTP Program: means a federally-approved comprehensive transition and postsecondary program, under 34 C. See Delaware Code Title 14 Sec. 3422A
- Custodian: means a nonparent who has been awarded custody of a child by order of the Family Court, but excludes the Department of Services for Children, Youth and Their Families when it or any of its divisions have been awarded custody by order of the Family Court. See Delaware Code Title 13 Sec. 2362
- Debilitated: means a person's state of chronic and substantial inability, as a result of a terminal illness, disease or injury to care for a child. See Delaware Code Title 13 Sec. 2362
- Debilitation: means a person's chronic and substantial inability, as a result of a terminal illness, disease or injury, to care for a child. See Delaware Code Title 13 Sec. 2362
- Decedent: A deceased person.
- Delaware bank: means a Delaware national bank or a Delaware state bank. See Delaware Code Title 5 Sec. 795
- Delaware national bank: means a national banking association created under the National Bank Act (12 U. See Delaware Code Title 5 Sec. 795
- Delaware state bank: means a bank (as defined in § 101 of this title) chartered under the laws of this State. See Delaware Code Title 5 Sec. 795
- Department: means the State Department of Elections, consisting of the State Board of Elections and such staff as the Board shall appoint under this title, but shall not include the State Election Commissioner. See Delaware Code Title 15 Sec. 101
- Department: means the Department of Education. See Delaware Code Title 14 Sec. 4503
- Department: means the Department of Services for Children, Youth & Their Families. See Delaware Code Title 14 Sec. 3432A
- Designated beneficiary: means , except as provided in § 3490 of this title, the individual designated at the time the account is opened as having the right to receive a qualified withdrawal for the payment of qualified education expenses or, if such designated beneficiary is replaced in accordance with § 3490 of this title, such replacement. See Delaware Code Title 14 Sec. 3485
- Determination of incapacity: means a written determination made by the attending physician which contains the physician's opinion to a reasonable degree of medical certainty regarding the nature, cause, extent and probable duration of the parent's, custodian's or guardian's incapacity. See Delaware Code Title 13 Sec. 2362
- Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
- Disqualifying felony: shall mean that type of felony set forth in § 2, article V of the Constitution of this State which permanently disqualifies any person convicted of such felony from voting. See Delaware Code Title 15 Sec. 6102
- District: means a reorganized school district. See Delaware Code Title 14 Sec. 4503
- District: means a reorganized school district and the school district of the City of Wilmington. See Delaware Code Title 14 Sec. 1901
- Division: shall mean the Division of Substance Abuse and Mental Health. See Delaware Code Title 14 Sec. 3802
- dollars: means lawful money of the United States. See Delaware Code Title 1 Sec. 302
- Donor: The person who makes a gift.
- Election Management System: refers to the computer programs and databases managed by the State Election Commissioner and used by the State Election Commissioner and the Department of Elections to maintain voter registration records, to manage absentee voting, maintain election officer information, maintain polling place information, structure elections and for other purposes. See Delaware Code Title 15 Sec. 101
- Election officers: means the inspector of election, the 2 judges of election and the clerks of election who are appointed for each election district under § 4702 of this title. See Delaware Code Title 15 Sec. 101
- Eligible costs: means tuition and all mandatory fees relating to attendance at the institution. See Delaware Code Title 14 Sec. 3432A
- Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
- Entity: shall mean any committee, agency or group approved by the Division; any law-enforcement committee, agency or group approved by the Department of Safety and Homeland Security; or any committee, agency or group composed of public school teachers and/or administrators. See Delaware Code Title 14 Sec. 3802
- Escrow: Money given to a third party to be held for payment until certain conditions are met.
- Executor: A male person named in a will to carry out the decedent
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
- Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
- Fiduciary: A trustee, executor, or administrator.
- Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
- Full-time: shall mean a minimum of 24 credit hours in each academic year. See Delaware Code Title 14 Sec. 3402A

- Hazing: means any action or situation which recklessly or intentionally endangers the mental or physical health or safety of a student or which wilfully destroys or removes public or private property for the purpose of initiation or admission into or affiliation with, or as a condition for continued membership in, any organization operating under the sanction of or recognized as an organization by an institution of higher learning. See Delaware Code Title 14 Sec. 9302
- High-need school: means any school either:
- Home State: means the state in which a child lived with a parent or a person acting as a parent for at least 6 consecutive months immediately before the commencement of a child custody proceeding. See Delaware Code Title 13 Sec. 1902
- Incapacity: means a person's chronic and substantial inability, as a result of mental impairment, to understand the nature and consequences of decisions concerning the care of the child, and a consequent inability to care for the child. See Delaware Code Title 13 Sec. 2362
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
- Indoor environment: means the overall potential health factors within a specific school, including air quality, mold levels, and other potentially harmful toxins. See Delaware Code Title 14 Sec. 4301
- Infancy: means an age of less than 18 years. See Delaware Code Title 1 Sec. 302
- Infant: means a person who has not reached the age of 18 years. See Delaware Code Title 1 Sec. 302
- Inhabitant: means a resident in any place. See Delaware Code Title 1 Sec. 302
- Initial determination: means the first child custody determination concerning a particular child. See Delaware Code Title 13 Sec. 1902
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Inspector: means inspector of elections. See Delaware Code Title 15 Sec. 101
- Institution: means such institutions of higher learning as may be from time to time established by the Board. See Delaware Code Title 14 Sec. 9101
- Institution: shall mean Delaware Technical and Community College or the University of Delaware, Associate in Arts Program. See Delaware Code Title 14 Sec. 3402A
- Institution: shall mean Delaware State University. See Delaware Code Title 14 Sec. 3410A
- Institution: means a state-funded institution of higher education in this State that offers a CTP Program. See Delaware Code Title 14 Sec. 3422A

- Insured depository institution: has the meaning specified in 12 U. See Delaware Code Title 5 Sec. 796
- Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
- Intestate: Dying without leaving a will.
- Issuing court: means the court that makes a child custody determination for which enforcement is sought under this chapter. See Delaware Code Title 13 Sec. 1902
- Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
- Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
- Judge: means judge of elections. See Delaware Code Title 15 Sec. 101
- Lawful age: means the age of 18 years or older. See Delaware Code Title 1 Sec. 302
- Lien: A claim against real or personal property in satisfaction of a debt.
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Loans: means consumer loans for personal, property or household purposes, mortgage loans and commercial loans other than to affiliates. See Delaware Code Title 5 Sec. 773
- Low-income students: means students within the statewide metric determined by the Department of Education utilizing direct certification for Temporary Assistance for Needy Families (TANF) and Supplemental Nutrition Assistance Program (SNAP). See Delaware Code Title 14 Sec. 4503
- Major political party: means any political party which, as of December 31 of the year immediately preceding any general election year, has registered in the name of that party voters equal to at least 5 percent of the total number of voters registered in the State. See Delaware Code Title 15 Sec. 101
- Merger: includes consolidation. See Delaware Code Title 5 Sec. 781
- Merger: includes merger, consolidation and the purchase or sale of all or substantially all assets. See Delaware Code Title 5 Sec. 795
- Merging bank: means a party to a merger. See Delaware Code Title 5 Sec. 781

- Modification: means a child custody determination that changes, replaces, supersedes or is otherwise made after a previous determination concerning the same child, whether or not it is made by the court that made the previous determination. See Delaware Code Title 13 Sec. 1902
- Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
- National bank: means a national bank association located in this State. See Delaware Code Title 5 Sec. 781
- National bank: means a Delaware national bank or an out-of-state national bank. See Delaware Code Title 5 Sec. 795
- National Bank Examiner: An employee of the Comptroller of the Currency whose function is to examine national banks periodically to determine the financial position of a bank and the security of its deposits. The examiner also verifies that the bank maintains procedures consistent with federal banking laws and regulations. Source: OCC
- Nonqualified withdrawal: means a withdrawal from an account that is not:
- Out-of-state bank: means an out-of-state state bank or an out-of-state national bank. See Delaware Code Title 5 Sec. 795

- Out-of-state state bank: means a state bank, as defined in the Federal Deposit Insurance Act, as amended, at 12 U. See Delaware Code Title 5 Sec. 795
- Oversight: Committee review of the activities of a Federal agency or program.
- Parent: means a biological or natural parent of a child with a disability, or, as appropriate, a stepparent, guardian, educational surrogate parent, appointed educational representative, relative caregiver or custodian. See Delaware Code Title 14 Sec. 3101
- Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, government, governmental subdivision, agency or instrumentality, public corporation, or any other legal or commercial entity. See Delaware Code Title 13 Sec. 1902
- Person acting as a parent: means a person, other than a parent, who:
- Person with a disability: means any person who by reason of a disability or impairment, whether congenital or acquired by accident, injury, disease or developmental circumstance, is or may be expected to be totally or partially incapacitated for remunerative occupation. See Delaware Code Title 14 Sec. 3301
- Physical custody: means the physical care and supervision of a child. See Delaware Code Title 13 Sec. 1902
- Plan: means the DE529 Education Savings Plan established by this subchapter. See Delaware Code Title 14 Sec. 3485
- Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
- political party: means any political organization which elects a state committee and officers of a state committee, by a state convention composed of delegates elected from each representative district in which the party has registered members, and which nominates candidates for electors of President and Vice-President, or nominates candidates for offices to be decided at the general election. See Delaware Code Title 15 Sec. 101
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Primary election: means an election at which voters registered as members of a major political party may vote to determine the nominees of that political party for the general election. See Delaware Code Title 15 Sec. 101
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Program: means a Grow Your Own Educator Program as established under this chapter. See Delaware Code Title 14 Sec. 4503
- Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
- Qualified education expenses: means tuition and other permitted expenses as set forth in 26 U. See Delaware Code Title 14 Sec. 3485
- Qualified withdrawal: means a withdrawal from an account to pay the qualified education expenses of the designated beneficiary, but only if the withdrawal is made in accordance with the requirements of the Plan. See Delaware Code Title 14 Sec. 3485
- Question: means any proposition or other question to be submitted to the voters. See Delaware Code Title 15 Sec. 101
- Recognized academic credential: shall mean a diploma or certificate of completion for a credit or noncredit training program consisting of 100 hours of instruction or more, or that requires a student to pass a licensure or certification examination approved by a federal, state or local government, regulatory body, or industry/trade group. See Delaware Code Title 14 Sec. 3402A
- Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
- Registration officers: means the registrar, assistant registrar and alternate registrars appointed by the Department as defined in this section. See Delaware Code Title 15 Sec. 101
- Registration record: means a voter's registration record maintained in the State's Election Management System, the list or file of registered voters sent to each election district for use by election officers on the day of the election, and until determined obsolete, it also applies to a voter's record maintained in the county master file. See Delaware Code Title 15 Sec. 101
- Remand: When an appellate court sends a case back to a lower court for further proceedings.
- Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
- Resulting bank: means the bank resulting from a merger or conversion. See Delaware Code Title 5 Sec. 781
- Savings and loan holding company: has the meaning specified in the Home Owners' Loan Act, as amended, at 12 U. See Delaware Code Title 5 Sec. 795
- School activity: shall mean open house, school curriculum night, parent and teacher conference night, holiday program, or other school-related events conducted by a public middle school or high school where parents, community members, and students are encouraged to attend and participate. See Delaware Code Title 14 Sec. 3402A

- Secretary: means the Secretary of the Department of Health and Social Services or such persons as may be designated by the Secretary. See Delaware Code Title 16 Sec. 101
- Signature: means both a written signature conforming to § 302(23) of Title 1 and a digital or electronic signature that is an electronic sound, symbol or process attached to or logically associated with a document and executed or adopted by a person with the intent to sign the document as specified by the State Election Commissioner. - State: means a State of the United States, the District of Columbia, Puerto Rico, the United State Virgin Islands or any territory or insular possession subject to the jurisdiction of the United States. See Delaware Code Title 13 Sec. 1902
- State bank: means a bank or trust company chartered under the laws of this State. See Delaware Code Title 5 Sec. 781
- State chair: means the highest executive officer of a political party of this State. See Delaware Code Title 15 Sec. 101
- State committee: means the regularly organized and constituted statewide governing authority of a political party in this State. See Delaware Code Title 15 Sec. 101
- State Election Commissioner: shall mean the State Election Commissioner or the Commissioner's designee. See Delaware Code Title 15 Sec. 6102
- Student with an intellectual disability: means a student with a cognitive impairment characterized by significant limitations in cognitive functioning and adaptive behavior as expressed in conceptual, social, and practical adaptive skills who meets 1 or both of the following:
- Students with disabilities: means students who because of mental, physical, emotional, developmental, speech or learning disability problems, as defined by the Department of Education rules and regulations, require special education and related services in order to develop their own capabilities. See Delaware Code Title 14 Sec. 4503
- Subcommittee: means the Reports Appeals Subcommittee of the State Board of Elections. See Delaware Code Title 15 Sec. 101
- Teacher: means any certificated professional employee of a public school district. See Delaware Code Title 14 Sec. 1401
- Teacher academies: means high school programs of study that prepare students for education careers by providing a career and technical education. See Delaware Code Title 14 Sec. 4503
- Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
- Testify: Answer questions in court.
- Tribe: means an Indian tribe or band, or Alaska Native village, which is recognized by federal law or formally acknowledged by a state. See Delaware Code Title 13 Sec. 1902
- Triggering event: means an event in the designation, petition or decree which empowers the standby guardian to assume the duties of the office, which event may be the death, incapacity, or debilitation of the parent, custodian, or guardian, whichever occurs first. See Delaware Code Title 13 Sec. 2362
- Trust: means a trust which is revocable or irrevocable and which has at least 1 individual as its current beneficiary. See Delaware Code Title 14 Sec. 3485
- Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
- Trust company powers: means all of the powers, rights, privileges and franchises incident to a trust company established under subchapter IV of this chapter, except:
- Tuition: means costs associated with coursework and CTP Program-related fees. See Delaware Code Title 14 Sec. 3422A
- Unaffiliated candidate: means any individual who files a declaration as a candidate for any office to be decided at the general election and who is not affiliated with any political party and has not been thus affiliated for at least 3 months prior to the filing of that individual's declaration. See Delaware Code Title 15 Sec. 101
- Under age: means an age of less than 18 years. See Delaware Code Title 1 Sec. 302
- Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
- User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
- Verdict: The decision of a petit jury or a judge.
- Violent felony: shall mean any felony listed in § 4201(c) of Title 11, except for drug-related offenses set forth in Title 16. See Delaware Code Title 14 Sec. 3402A
- Vocational rehabilitation: means the rendering of a person with a disability fit to engage in remunerative occupation. See Delaware Code Title 14 Sec. 3301
- waiver: means the Delaware Fostering Independence Through Education Tuition Waiver Program established under this subchapter. See Delaware Code Title 14 Sec. 3432A
- Warrant: means an order issued by a court authorizing law enforcement officers to take physical custody of a child. See Delaware Code Title 13 Sec. 1902
- Writ: A formal written command, issued from the court, requiring the performance of a specific act.
