This rule chapter shall not restrict the Department’s right to take immediate remedial action, including the modification of a connection if there is an immediate and serious danger to the public health, safety, and welfare as determined in writing by the District Secretary or designee. Upon determination that there is a need for immediate remedial action against hazards, the District Secretary or designee shall issue an order in compliance with Florida Statutes § 120.60, and the Department shall provide the property owner and occupant with written notice of the Department’s immediate action to modify the connection and of the right to contest the decision pursuant to Rule Fl. Admin. Code Chapter 28-106
