(1) Unless made concurrently with the Notice, an Application For Carryforward pursuant to Florida Statutes § 159.81, shall be submitted to the Division on Form BF 2009, which shall contain the following information:
(b) Whether the bonds will finance a Priority Project;
(c) The Division Serial No. of the original Notice (not required if application is made concurrently with Form BF 2006, or if the original Confirmation has not been received);
(d) The name, address and telephone number of the person who prepared the Application (and to whom the approval or rejection of carryforward will be sent);
(e) The name of the issuing Agency;
(f) The name of the company, if any, which will benefit from or use the proceeds of the bonds;
(g) The amount of Private Activity Bonds proposed to be issued;
(h) The purpose of the bonds, including the name of the project;
(i) The contemplated date(s) of issuance of the bonds; and
(j) The name of the Approving Authority; and shall be signed by the Agency official who executed the original Notice, or by the person who prepared the Notice.
(2) Copies of Form BF 2009 are available on request from the Division. Use of photocopies of the form is authorized.
(3) Application for carryforward may be made concurrently with the submission of a Notice by writing the words “”Carryforward Requested”” in Part I of the Notice, or by indicating such request in a cover letter accompanying the Notice. The designation of a project as a Priority Project on the Notice will not be considered a request for carryforward approval.
(4) Applications For Carryforward for projects which are qualified for carryforward under section 146(f)(5) of the Code, but which are not Priority Projects, will not be considered until December 30, although such application will be accepted at any time.
(5) No Application For Carryforward will be accepted after bonds are issued pursuant to a Confirmation for the subject project, or after December 31 of the calendar year in which the Notice was submitted.
(6) If an Application For Carryforward is received by the Division before Part II of the Notice (Form BF 2006) has been completed and returned to the applicant, the approval or rejection of carryforward will be noted on the Form BF 2006. If received after such time, notification of approval or rejection of carryforward will be made by other written communication.
