(1) The Florida Department of State has primary jurisdiction to resolve through an informal resolution process complaints submitted by any person who is aggrieved by a violation of the National Voter Registration Act of 1993 or a violation of a voter registration or removal procedure under the Florida Election Code. Such complaints can only be filed under Florida Statutes § 97.023, if the alleged violation was committed by the Florida Department of State, a voter registration agency, a supervisor of elections, the Florida Department of Highway Safety and Motor Vehicles, or an Armed Forces Recruitment Center. If the complaint involves the Florida Department of State, a mediator other than a department employee is to be appointed by the Governor.
(2) To initiate the informal dispute resolution process under Florida Statutes § 97.023, a person must submit a written complaint to the Florida Department of State. Such person shall use Form DS-DE 18 (eff. 01/06), entitled “”NVRA Complaint,”” which is hereby incorporated by reference. This complaint form may be obtained by contacting the Division of Elections at (850)245-6200, by requesting the form from the Division of Elections, 3rd Floor, R.A. Gray Building, 500 S. Bronough Street, Tallahassee, Florida 32399 or by downloading the form from the Division of Elections home page at: http://election.dos.state.fl.us.
