Where vested rights in property exist pursuant to Florida Statutes § 380.05(18), these regulations shall not abridge them. Any person whose rights may have vested pursuant to Florida Statutes § 380.05(18), may seek a determination from the local government having jurisdiction over development or from the state land planning agency. Request for vested rights determination from the agency shall be submitted as a petition for a declaratory statement pursuant to Florida Statutes § 120.565, and upon a form as prescribed by the agency.
