Terms Used In Florida Regulations 59A-36.005

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
    (a) Fl. Admin. Code R. 64E-12.004, and rule chapter 64E-11, F.A.C., relating to food hygiene.
    (b) Fl. Admin. Code Chapter 64E-12, relating to sanitary practices in community-based residential facilities.
    (c) Fl. Admin. Code Chapter 64E-16, relating to biomedical waste.
    (2) The local authority having jurisdiction over fire safety or State Fire Marshal is responsible for inspecting all license applicants and licensed facilities in matters regulated by Florida Statutes § 429.41, relating to uniform fire safety standards and chapter 69A-40, F.A.C., Uniform Fire Safety Standards for Assisted Living Facilities.
    (3) The agency is responsible for inspecting all license applicants and licensed facilities in all other matters regulated by this rule chapter.
