(1) Whenever the Department finds a licensee guilty of violating a provision of Chapter 469 or 455, F.S., the following Disciplinary Guidelines shall be followed. Penalties imposed by the Department pursuant to Fl. Admin. Code Chapter 61E1-6, may be imposed in combination or individually but may not exceed the limitations enumerated below.   • Contract: A legal written agreement that becomes binding when signed.
  • Fraud: Intentional deception resulting in injury to another.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
    (2) Minor Violations.
    (a) Subject to the limitations imposed by this rule, the following violations are designated as minor for the purposes of Florida Statutes § 455.225(3)

    2. Violation of Section 469.006(5)(b), F.S.
    (b) The designation of violations as minor for the purposes of Florida Statutes § 455.255(3), is limited to initial violations.
