(1) The determination as to whether probable cause exists to believe a violation of the provisions of Chapter 456 or 468, Part II, F.S., or the rules promulgated thereunder has occurred shall be made by a majority vote of a probable cause panel of the Board.
(2) The probable cause panel shall be composed of at least two (2) but not more than three (3) members, one of whom is authorized to be a past Board member. The probable cause panel shall be appointed by the Board Chair.
