Pursuant to Florida Statutes § 456.048, all anesthesiologist assistants shall carry malpractice insurance or demonstrate proof of financial responsibility. Any applicant for licensure shall submit proof of compliance with Florida Statutes § 456.048, or submit proof that the applicant meets the criteria to be granted an exemption to the Board office prior to licensure. All licensees shall submit such proof as a condition of biennial renewal or reactivation. Acceptable proof of financial responsibility shall include:
(1) Professional liability coverage of at least $100,000 per claim with a minimum annual aggregate of at least $300,000 from an authorized insurer under Florida Statutes § 624.09, a surplus lines insurer under Florida Statutes § 626.914(2), a joint underwriting association under Florida Statutes § 627.351(4), a self-insurance plan under Florida Statutes § 627.357, or a risk retention group under Florida Statutes § 627.942, or
(2) An unexpired irrevocable letter of credit as defined by Florida Statutes Chapter 675, which is in the amount of at least $100,000 per claim with a minimum aggregate availability of at least $300,000 and which is payable to the anesthesiologist assistant as beneficiary. Any person claiming exemption from the financial responsibility law pursuant to Florida Statutes § 456.048(2), must timely document such exemption at initial certification, biennial renewal, and reactivation.
(3) A licensee seeking to renew a license, reactivate an inactive license or update a previously filed financial responsibility disclosure must complete form DH-MQA 1088, Anesthesiologist Assistant Financial Responsibility, (Rev. 4/16), which is hereby adopted and incorporated by reference and can be obtained from the website at http://www.flrules.org/Gateway/reference.asp?No=Ref-07280, or from the Board’s website at http://flboardofmedicine.gov/licensing/anesthesiologist-assistant-licensure/. The licensee may also obtain the form by contacting the Board of Medicine at 4052 Bald Cypress Way, Bin #C03, Tallahassee, FL 32399-3253.
