- Aggregator site: means a website that provides access to information regarding insurance products from more than one insurer, including product and insurer information, for use in comparison shopping. See Florida Statutes 647.02
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Blanket travel insurance: means a policy of travel insurance issued to an eligible group providing coverage to all members of the eligible group without a separate charge to individual members of the eligible group. See Florida Statutes 647.02
- Cancellation fee waiver: means a contractual agreement between a supplier of travel services and its customer to waive some or all of the nonrefundable cancellation fee provisions of the supplier's underlying travel contract with or without regard to the reason for the cancellation or form of reimbursement. See Florida Statutes 647.02
- Contract: A legal written agreement that becomes binding when signed.
- Department: means the Department of Financial Services. See Florida Statutes 647.02
- Dependent: A person dependent for support upon another.
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Fulfillment materials: means documentation sent to the purchaser of a travel protection plan confirming the purchase and providing the travel protection plan's coverage and assistance details. See Florida Statutes 647.02
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Limited lines travel insurance producer: means :(a) A licensed or third-party administrator;(b) A licensed insurance producer, including a limited lines producer; or(c) A travel administrator. See Florida Statutes 647.02
- person: includes individuals, children, firms, associations, joint adventures, partnerships, estates, trusts, business trusts, syndicates, fiduciaries, corporations, and all other groups or combinations. See Florida Statutes 1.01
- Travel administrator: means a person who directly or indirectly underwrites policies for; collects charges, collateral, or premiums from; or adjusts or settles claims made by residents of this state in connection with travel insurance, except that a person is not considered a travel administrator if the person is:
(a) A person working for a travel administrator, to the extent that the person's activities are subject to the supervision and control of the travel administrator;(b) An insurance producer selling insurance or engaged in administrative and claims-related activities within the scope of the producer's license;(c) A travel retailer, as defined in…. See Florida Statutes 647.02- Travel assistance services: means noninsurance services for which the consumer is not indemnified based on a fortuitous event, and the provision of which does not result in the transfer or shifting of risk which would constitute the business of insurance. See Florida Statutes 647.02
- Travel insurance: means insurance coverage for personal risks incidental to planned travel, including:
(a) Interruption or cancellation of trip or event;(b) Loss of baggage or personal effects;(c) Damages to accommodations or rental vehicles;(d) Sickness, accident, disability, or death occurring during travel;(e) Emergency evacuation;(f) Repatriation of remains; or(g) Any other contractual obligations to indemnify or pay a specified amount to the traveler upon determinable contingencies related to travel, as determined by the office. See Florida Statutes 647.02- Travel protection plan: means a plan that provides one or more of the following: travel insurance, travel assistance services, and cancellation fee waivers. See Florida Statutes 647.02
- Trustee: A person or institution holding and administering property in trust.
