Terms Used In Florida Statutes 947.1746
- Commission: means the Florida Commission on Offender Review. See Florida Statutes 947.005
- Department: means the Department of Corrections. See Florida Statutes 947.005
- Effective parole release date: means the actual parole release date as determined by the presumptive parole release date, satisfactory institutional conduct, and an acceptable parole plan. See Florida Statutes 947.005
- Presumptive parole release date: means the tentative parole release date as determined by objective parole guidelines. See Florida Statutes 947.005
Within 30 days of the receipt of new information or upon receipt of a written recommendation from the department that an inmate be considered for mitigation of the authorized presumptive parole release date, the commission may, at its discretion, provide for a final interview to establish an effective parole release date or may review the official record and establish an effective parole release date without provision of a final interview, unless an interview is requested by no fewer than two commissioners.
