N.Y. Public Health Law 2587 – Program approval
§ 2587. Program approval. 1. Eligible institutions seeking cash assistance under the program shall submit an application to the commissioner. Such application shall be in a format and quantity determined by the commissioner, and shall include:

- Eligible institution: means any child or adult day care institution defined in federal law, rule or regulations eligible to receive cash assistance under the federal child care and adult food program. See N.Y. Public Health Law 2586
- Program: means the federal child care and adult food program. See N.Y. Public Health Law 2586
(a) a general description of the proposed program;
(b) a copy of a valid license or other approval issued by the department, the department of social services or other state agency to provide or sponsor child or adult day care programs; and
(c) such other information as required by the commissioner.
2. The commissioner shall not approve an eligible institution for receipt of cash assistance under this title unless the applicant:
(a) accepts final administrative and financial responsibility for management of an effective food service;
(b) possesses a valid license or other approval issued by the department, the department of social services or other state agency to operate or sponsor child or adult day care programs;
(c) has not been seriously deficient in its operation of the program or any other program specified in federal law, rule or regulation;
(d) demonstrates that it will provide adequate supervisory and operational personnel for overall monitoring and management of the program; and
(e) meets standards prescribed in federal law, rule or regulation.
3. The commissioner shall provide written notice of approval or disapproval of the proposed application to the applicant.
