§ 617. Recalculation of benefits. a. Notwithstanding any other provision of law, any person who has retired pursuant to the provisions of article fourteen of this chapter on or before August thirty-first, nineteen hundred eighty-three, whether for service retirement or for ordinary or accidental disability retirement, may elect to have his or her retirement benefits recalculated pursuant to this article, from such person's date of retirement; provided, however, such person was not employed in a position excluded from the application of this article by paragraphs one through five of subdivision a of section six hundred of this article. The recalculation of benefits shall be based upon the option selection originally filed for retirement.

b. To elect the recalculation, such person shall, on or before December thirty-first, nineteen hundred ninety-nine, file a request for such recalculation with the appropriate retirement system in the form and manner prescribed by the head of such retirement system.
