§ 97-mmm. Archives records management account. 1. There is hereby established in the joint custody of the state comptroller and the commissioner of the department of taxation and finance an account of the miscellaneous internal service fund to be known as the archives records management account.

Notwithstanding any other law, rule or regulation to the contrary, expenditures from the archives records management account shall support records management activities pursuant to § 57.05 of the arts and cultural affairs law. This account shall consist of fees charged to state, local and miscellaneous agencies, in accordance with § 57.05 of the arts and cultural affairs law.

3. Notwithstanding any other law, rule or regulation to the contrary, the comptroller is hereby authorized and directed to transfer to the archives records management account, within forty-five days of enactment of the state budget, fees for records management activities from various state, local and miscellaneous agencies, and deposit in the archives records management account such amounts as determined by a schedule of fees developed by the commissioner of education and approved by the director of the budget, pursuant to § 57.05 of the arts and cultural affairs law.

4. Moneys of this account, following appropriation by the legislature, shall be available to the state education department for services and expenses of archives records management.
