Terms Used In 10 Guam Code Ann. § 12906
- Conviction: A judgement of guilt against a criminal defendant.
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
(b) Any person who knowingly and willfully violates any of the provisions of this Article or the regulations adopted pursuant thereto a second time or more is guilty of a felony.
(c) In addition to any other penalties prescribed by law, the Board may, after notice and an opportunity for hearing as required by law, impose upon any person who violates any provision of this Article or the regulations adopted pursuant thereto an administrative fine of not less than Two Thousand Five Hundred Dollars ($2,500) and not more than Ten Thousand Dollars ($10,000).
(d) The Board, its members, staff, and employees shall also be entitled to recover and be reimbursed for all costs and expenses incurred in the prosecution and defense of any proceeding before the Board or before the courts of Guam, including the U.S. District Court of Guam. Costs and expenses that are subject to recovery and reimbursement by the Board include, but are not limited to,

filing fees, attorneys’ fees, hearing officer fees, deposition fees, expert witness fees, travel and lodging for witnesses and experts, and all other expenses incurred in the prosecution or defense of this Article, the regulations adopted pursuant thereto, any decision of the Board and any member of the Board or its staff acting in good faith and within the scope and function of the Board as determined in the sole discretion of the Attorney General of Guam.
