Terms Used In 15 Guam Code Ann. § 4201

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Personal property: All property that is not real property.
  • Probate: Proving a will
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
the income of an estate under guardianship is insufficient for the support, maintenance and education of the ward and of such members of his family as he is legally obligated to support and maintain, including his care, treatment and support, if confined in a hospital, or if the personal estate and the income from the real estate is insufficient to pay his debts, his guardian may sell any of his real or personal property or mortgage any of his real property for that purpose, subject to confirma- tion or direction by the court as hereinafter provided.
