Terms Used In 16 Guam Code Ann. § 7165

  • Conviction: A judgement of guilt against a criminal defendant.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
(a) Any owner, and any person acting on behalf of an owner, who shall submit an application for registration or renewal of registration of a vehicle, knowing that the gross weight of such vehicle is understated in such application, shall be guilty of a misdemeanor.

(b) Where the Director of Revenue and Taxation, or his authorized representative, has accepted the statement as to gross weight of a vehicle made by an owner, or by any person acting on behalf of an owner, in an application for registration or renewal of registration, pursuant to § 7164, evidence that a subsequent weighing of the vehicle indicates a gross weight of the vehicle in excess of that set forth in the application shall constitute a prima facie case sufficient to warrant a conviction under Paragraph (a) of this Section.
