enforcement within Guam of Occupational Safety and Health standards relating to any Occupational Safety and Health issue with respect to which a Federal standard has been promulgated; and to assume responsibility for development and enforcement over any occupational safety and health issue with respect to which no Federal standard is in effect under section 6 of Public Law 91-596. This Act shall apply with respect to employment performed in a work place in Guam. Nothing in this Act shall apply to working conditions of employees with respect to which other Federal agencies, and territorial agencies acting under § 274 of the Atomic Energy Act of 1954, as amended (42 U.S.C. § 2021), exercise statutory authority to prescribe or enforce standards or regulations affecting occupational safety or health. the Director shall within three (3) years after the effective date of this Act, report to the Legislature his recommendations for legislation to avoid unnecessary duplication and to achieve coordination between this Act and other Federal laws or territorial laws. This Act will take effect immediately upon approval of Guam’s 18(b) plan and shall apply with respect to employment performed in a work place in Guam.
