- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
There is hereby created the Guam Plant Inspection and Permit Fund. This Fund shall be used exclusively for the adminis- tration, operation, maintenance and improvement of the Plant Inspection Station of the Department of Agriculture and is subject to I Liheslaturan Guåhan [Legislative] appropriation. The Guam Plant Inspection and Permit Fund shall be maintained separate and apart from any other funds of the government of Guam and shall not be subject to any transfer authority of I Maga’lahen Guåhan [the Governor]. The Director of the Department of Agriculture is hereby required to establish a fee schedule for services provided by the Plant Inspection Station and update all permit fees associated with the issuance of phytosanitary permits inclusive to permit fees and other ancillary operational fees on the importation and exportation of any regulated flora, fauna, or by-product thereof under the jurisdiction of the Department of Agriculture. The fee schedule shall be adopted following the Administrative Adjudication Act. All funds generated from the fee schedule shall be deposited into the Guam Plant Inspection and Permit Fund.
