Terms Used In Hawaii Revised Statutes 124B-12
- Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
- Military: refers to any or all of the armed forces. See Hawaii Revised Statutes 124B-1
- Officer: means a commissioned officer. See Hawaii Revised Statutes 124B-1
- State military forces: means the National Guard of the State, as defined in title 32 United States Code § 101(3), the organized naval militia of the State, and any other military force organized under the laws of the State. See Hawaii Revised Statutes 124B-1
Any civil officer having authority to apprehend alleged offenders under the laws of the United States or this State or of a state, territory, commonwealth, or possession, or the District of Columbia, may summarily apprehend an alleged deserter from the state military forces and deliver the alleged deserter into the custody of the state military forces. If an alleged offender is apprehended outside the State, the alleged offender’s return to the State shall be in accordance with normal extradition procedures or reciprocal agreement.
