Terms Used In Hawaii Revised Statutes 124B-16
- Arrest: Taking physical custody of a person by lawful authority.
- Arrest: means the restraint of a person by an order, not imposed as a punishment for an offense, directing the person to remain within certain specified limits. See Hawaii Revised Statutes 124B-1
- Confinement: means the physical restraint of a person. See Hawaii Revised Statutes 124B-1
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Verdict: The decision of a petit jury or a judge.
Subject to section 124B-93, no person while being held for trial or awaiting a verdict shall be subjected to punishment or penalty other than arrest or confinement upon the charge pending against the person, nor shall the arrest or confinement imposed upon the person be any more rigorous than the circumstances require to insure the person’s presence; provided that the person may be subjected to minor punishment during that period for infractions of discipline.
