(a) No person shall consume, purchase, possess, sell, offer for sale, or otherwise distribute powdered alcohol in the State.

Terms Used In Hawaii Revised Statutes 281-5

  • Alcohol: means the product of distillation of any fermented liquid, whether rectified or not, whatever may be the origin thereof, and includes synthetic ethyl alcohol, but not denatured or other alcohol which is considered nonpotable under the customs laws of the United States. See Hawaii Revised Statutes 281-1
  • Conviction: A judgement of guilt against a criminal defendant.
  • Person: means and includes natural persons, associations, copartnerships, limited liability companies, and corporations, and also includes any agent, servant, and employee of such person. See Hawaii Revised Statutes 281-1
(b) Any person who violates this section shall be guilty of a misdemeanor and upon conviction shall be punished as provided in section 281-102.
(c) As used in this section, “powdered alcohol” means a powdered or crystalline substance that contains any amount of alcohol for either direct use or reconstitution.
(d) This section does not apply to the use of powdered alcohol for legal commercial uses or bona fide research purposes by:

(1) A health care provider who uses powdered alcohol for the purpose of conducting scientific research;
(2) A state institution;
(3) The University of Hawaii, or other accredited educational or research institution; or
(4) A pharmaceutical or biotechnology company.
